Important SB798 Update!

Help Stop CA’s Anti-Gun Cities From Getting Power To Ban firearms, Airsoft, BB and Paintball guns. Protect State Preemption!

Contact the California Assembly Public Safety Committee today and urge them to oppose SB 798 (De Leon). The bill is being amended and brought up for reconsideration next Tuesday (July 5). After you contact your Legislators March on the Capitol and show your opposition!

You may not be able to testify at the 9:30 a.m. hearing but what you can do is:

  • Visit your Assembly Member and Senator before the hearing.
  • Let them know what you think about SB 798, as now amended.

Since this is a reconsideration hearing, State Sen. Kevin DeLeon will be allowed to present amendments to SB 798, but there will be no public support or opposition testimony allowed.

The amendments will completely void all language in the current bill and will include a repeal of the existing state preemption ordinance which regulates imitation firearms including airsoft guns, paintball guns, BB guns and pellet guns (Government Code Section 53071.5). If state preemption, which forbids localities from passing their own gun control measures, is over-ridden here, the door will be open for municipalities across the state to write their own gun control ordinances affecting ALL types of firearms. This would create criminals out of law-abiding citizens for merely turning down the ‘wrong’ street and crossing over a city border. Furthermore, by enacting such laws, cities would be able to apply business-killing regulations on lawful firearms, Airsoft, BB gun and Paintball retailers.

State preemption laws mandate equal treatment of all state residents. These preemption laws must stay intact in order to provide uniform statewide firearms laws and prevent municipalities from creating a patchwork of different firearms-related ordinances.

Please, take a few minutes and call the following committee members today! Politely ask them to oppose SB 798!

We won the battle but not the war!

On June 21, 2011 the public safety committee in the California State Assembly voted down SB798. The bill was defeated with a 5-2 vote. This is an amazing feat for the Airsoft community. Politicians tend to strictly vote party lines, and with a 5-2 majority of democrats in the public safety committee, SB798 was favored to pass. Even though the bill was voted down it doesn’t mean we’ve won. The bill is up for reconsideration, which means it could be rewritten and resubmitted as early as July 5th.

California Is Taking Away Your Black Airguns FOREVER

Warrensville Heights, OH – -(Ammoland.com)- No more black airguns! If you enjoy shooting your Walther PPK/S or a Crosman C11, you better get used to them being ALL red or ALL blue or ALL green — or completely clear!

California State Senator Kevin de Leon thinks your black airguns are dangerous and has proposed CA Senate Bill 798 to stop you from having them. SB 798 states that all airguns MUST be painted brightly. No more black guns!

Some background
In December 2010, three boys were shooting their airsoft guns in a public park. It was dark, but their pistols had orange muzzles. The police confronted them and ordered them to put down their guns. Two boys complied but the third did not. He was shot and suffered severe injuries.

To prevent another such occurrence, Sen. de Leon had a knee-jerk reaction and wrote SB 798 to stop EVERYONE from buying, owning or shooting black airguns.

It gets worse!
This new law also affects airsoft guns, which millions of people safely use for re-enactments, skirmishing and maintaining firearm proficiency.

If you hate orange muzzles on your airsoft guns, what are you going to do when the ONLY airsoft guns you can buy, carry or shoot are red, blue, green or completely clear?

California’s Penal Code prohibits the sale and distribution of imitation firearms. BB devices, which are listed as airsoft guns and BB guns, are specifically excluded from that law. HOWEVER, SB 798 adds airsoft guns and BB guns to the list of imitation firearms that are prohibited UNLESS those guns are brightly colored.

YOU are guilty
Because you shoot a “BB device,” Sen. de Leon thinks you’re not a responsible person and must be forced to have brightly colored guns for your own protection. Basically, he’s saying you’re guilty by association because you shoot one of these guns!

While we sympathize with the boy who was injured in last December’s incident, that does not give Sen. de Leon the right to include every airsoft or BB gun owner as someone who needs the government to tell them what to do.

What you can do
If California passes this bill, other states will get similar bills going. Whether you live in California or elsewhere, show your support for airsoft and airgun owners everywhere.
